Duties Description Candidates selected as a Principal Attorney within NYSDOT’s Division of Legal Affairs will perform the following duties:

1. Serve as part of the upper management counsel team for the Division of Legal Affairs reporting directly to the General Counsel.
2. Supervise and manage the work of attorneys covering multiple functional areas of law including, but not limited to, Transportation Law, Highway Law, Finance Law, Civil Rights, Vehicle and Traffic Law, Executive Law, State and Federal Railroad, Federal Highway, Transit and Aviation Administration, as well as traffic safety, highway construction and maintenance, and highway beautification.
3. Provide expert legal advice and strategic solutions to support DOT’s mission and programs. Advise counsel on legal matters having a bearing on the agency’s work, procedures, and policies.
4. Engage cross-functionally with program areas to ensure that the Department's mission, goals, and interests are properly represented in all policy development, litigation, and administrative proceedings.
5. Act as the Department’s advocate in determining approaches for novel legal issues among internal legal management and executive staff.
6. Manage, develop, and support a group of lower-level attorneys and legal supervisors engaged in the preparation of legal cases for which there is little precedent and/or which have a major impact on an agency's mission and program; analyze legal opinions, prepare briefs, memoranda of law, and other material, interpret and confer with administrators or outside parties to legal action in order to mediate, negotiate, or settle legal issues related to the agency's mission and programs.
7. Guide supervising attorneys and/attorney teams, in: development of legal strategies, develop detailed work plans, review of draft regulations, proposed pleadings, subpoena responses, oversight of administrative actions, and implementation of recently enacted legislation.
8. Lead or oversee teams handling negotiations, legislation/regulation development, and legal issues that are precedent setting, unique, or highly sensitive.
9. Foster cooperation and communication on legal matters with external stakeholders; including but not limited to, sister states, federal and state agencies, authorities, municipalities, elected officials, industry representatives, and the public. Build and nurture strong relationships as a key partner in achieving the state’s transportation goals.
10. Coordinate and interpret pertinent policies, laws, rules, regulations, etc. for the compliance and enforcement issues of the agency. Assist legal and programmatic staff in the development of procedures, training, and guidance, based thereon.
11. Appropriately handle confidential and sensitive matters within the Division and Department at large.


Responsibilities may include serving a role within the Incident Command System to support the department's response to regional and statewide emergency situations.

Minimum Qualifications In order to be considered for appointment, candidates must be reachable from the appropriate Civil Service eligible list or be eligible for reassignment or transfer in accordance with Civil Service Law.
